Chapter 7 - Straight Bankruptcy

If you owe more money than you can be expected to pay in the near future, you may want to consider Chapter 7.  Chapter 7 allows the debtor to have the Bankruptcy Court "discharge" or cancel most of his or her debts to obtain a fresh start.  Chapter 7 generally stops bill collectors from calling you and prevents creditors from garnsihing your wages or bank accounts.  You may be able to protect most of your personal property through Chapter 7.

Chapter 13 - Wage Earner Plan

If you have a steady source of income through wages, self-employment, support or government benefits, you may be able to file Chapter 13.  This plan offers a way for you to reorganize your finances, allowing you to pay part or all of the debts over a three to five year period under court supervision.  During this time, most creditors are prevented from starting or continuing collection efforts.
